Man out with dog ordered to stop recording

Another case where photographer wrongly asked to stop by police.

Jailhouse Lawyer was only out walking his dog in Hull at the weekend when he came upon a road traffic accident, he was already using his camera phone to record the walk with his dog and stopped to see what was going on. Of course he had intentions to report the matter on his blog and possibly also on YouTube describing himself as a “citizen journalist,……merely recording a newsworthy event of legitimate public interest.”

That was until  the police asked him to put a stop to his recording. Unfortunately we don’t get to hear which powers the police in Hull were attempting to use in order to carry out this intrusion, nor which Act of Parliament they intended to use when threatening to take away his mobile phone. Unfortunately for them they appear not to have seen the advice given to the Metropolitan Police Service perhaps it hasn’t filtered through to Humberside, and they may find that they have picked on the wrong man.

The prolific blogger and penal reform campaigner intends to sue for damages over a  breach of section 6(1) of the Human Rights Act 1998.

So when you consider that purchase of the iPhone or Nokia N97, or indeed the flashy new Nikon or Canon camera, be careful to also consider whether you have sufficient freedom and liberty to use them on Britain’s streets.
